1. Acceptance of Terms

By accessing or using the VehTap website (vehtap.com), purchasing any VehTap product, activating a VehTap tag, or using any VehTap service in any manner, you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and VehTap.

If you do not agree to these Terms in their entirety, you must immediately cease using the website and all associated services. Continued use of the website or any VehTap product after any modification to these Terms constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Maharashtra, India, and the applicable laws of the Republic of India, including but not limited to the Information Technology Act, 2000, the Consumer Protection Act, 2019, and all rules and regulations made thereunder.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • "VehTap" refers to the brand, website, platform, products, and services operated by the proprietor.
  • "Tag" refers to any physical QR code sticker or digital tag product sold under the VehTap brand, including eTag, Pro Tag, and Pro Tag Duo.
  • "User" or "Owner" refers to any individual who purchases a Tag and registers it on the VehTap platform.
  • "Scanner" refers to any third party who scans the QR code on a Tag to contact the Owner.
  • "Platform" refers to the VehTap website (vehtap.com), its subdomains, APIs, and associated digital infrastructure.
  • "Services" refers to the contact relay, masked communication, tag activation, and dashboard features provided by VehTap.
  • "Activation" refers to the process by which a User links a Tag to their vehicle and phone number on the Platform.
  • "Personal Data" has the meaning ascribed under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

3. Description of Service

VehTap provides a privacy-first vehicle contact system that enables a Scanner to contact a vehicle owner without either party's phone number being disclosed to the other. The Service operates as follows:

  1. The Owner purchases a Tag and receives a PDF containing a unique QR code.
  2. The Owner activates the Tag by scanning the QR code, completing phone OTP verification, and providing vehicle details.
  3. A Scanner scans the activated Tag's QR code on the vehicle and is presented with contact options (Call, SMS, WhatsApp).
  4. VehTap relays the contact attempt through masked communication infrastructure, ensuring neither party's phone number is revealed to the other.
  5. The Owner receives the contact attempt on their registered phone number.

VehTap does not guarantee that contact attempts will always be successful. The availability of specific contact methods depends on the Owner's configured preferences and the operational status of third-party communication providers.

4. Products and Pricing

4.1 Product Range

VehTap currently offers the following products:

  • eTag — Digital QR code tag, delivered as a PDF. No physical sticker.
  • Pro Tag — Physical QR code sticker with digital activation. Recommended.
  • Pro Tag Duo — Two physical QR code stickers with digital activation.

All prices are inclusive of applicable taxes unless stated otherwise. VehTap reserves the right to modify pricing at any time without prior notice.

4.2 Digital Delivery

Upon successful payment, the User receives a PDF containing the QR code(s) via email. The User may re-download their PDF at any time by logging into their dashboard at vehtap.com/dashboard.

4.3 Physical Delivery

For Pro Tag and Pro Tag Duo, VehTap will dispatch the physical sticker(s) within 3 to 5 business days of order confirmation. Delivery timelines are estimates and not guarantees. VehTap shall not be held liable for delays caused by courier partners, force majeure events, or circumstances beyond its reasonable control.

4.4 Tag Gifting and Multiple Users

A Tag may be purchased by one individual and activated by a different individual (for example, as a gift). The person who activates the Tag ("the Activating User") becomes the registered Owner for all purposes under these Terms from the point of activation.

Once a Tag is activated and linked to a phone number, the association between the Tag and the registered phone number is permanent and cannot be changed. Tags are not transferable between phone numbers or users after activation. If the Activating User wishes to discontinue use, they may request account deletion, which will result in permanent deactivation of all associated Tags.

VehTap is not responsible for disputes between a purchaser and an activating user arising from the gifting or transfer of a Tag.

4A. Service Continuity and Changes

VehTap provides its digital services — including the contact relay, masked communication, tag activation, and dashboard — on a best-efforts basis. While VehTap endeavours to maintain continuity of service, VehTap reserves the right to modify, limit, restructure, or discontinue any feature of the Service, including introducing fees for features currently provided at no charge, at any time and with or without prior notice to Users.

Where VehTap determines it is reasonably practicable to do so, it will endeavour to communicate material changes to registered Users via email. However, VehTap is under no obligation to provide advance notice and the absence of notice shall not give rise to any claim or liability against VehTap.

Your continued use of the Platform or any activated Tag following any such change constitutes your acceptance of the revised terms of service. If you do not accept a change, your sole remedy is to cease use of the Service. No refund, compensation, or credit shall be payable to you as a result of any such modification or discontinuation.

5. Refund and Cancellation Policy

5.1 No Refund Policy

ALL SALES ARE FINAL. VehTap operates a strict no-refund policy. Once payment is received and the digital product (PDF) has been made available to the User, no refund will be issued under any circumstances, including:

  • Change of mind or decision not to use the product.
  • Inability to activate or use the Tag due to User error.
  • Incompatibility with the User's intended use.
  • Delay in physical delivery within the stated 3 to 5 business day window.
  • Dissatisfaction with product features or service.

5.2 Physical Tag — Limited Warranty

VehTap's physical stickers are manufactured to be weather-resistant and suitable for outdoor use on vehicle windscreens and surfaces. However, VehTap provides no express or implied warranty regarding the durability, longevity, or performance of any physical sticker under any specific conditions of use.

VehTap will consider a warranty claim solely in the following circumstance: the QR code on the physical sticker is completely unscannable immediately upon receipt or within a reasonable period of first use, due to a manufacturing defect and not as a result of physical damage, improper application, or environmental exposure after delivery.

To submit a warranty claim, the User must:

  • Contact support@vehtap.com within 7 days of receipt of the physical sticker
  • Provide a clear video demonstrating that the QR code cannot be scanned using a standard smartphone camera
  • Provide the order number and delivery details

VehTap, at its sole discretion, may offer a replacement sticker upon verification of a valid claim. This does not constitute a right to a monetary refund. Claims submitted after 7 days of receipt, or without video evidence, will not be considered. Normal wear, fading, partial damage, or difficulty scanning attributable to improper application or environmental conditions does not qualify as a manufacturing defect.

5.3 Order Cancellation

Orders cannot be cancelled once payment has been successfully processed.

6. User Obligations and Prohibited Conduct

6.1 Eligibility

You must be at least 18 years of age to purchase or use VehTap products and services.

6.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials. Notify VehTap immediately at support@vehtap.com if you suspect unauthorised access to your account.

6.3 Prohibited Conduct

You agree not to use VehTap for:

  • Harassment, stalking, threatening, or intimidating any person through the contact relay system.
  • Fraudulent or deceptive communications.
  • Reverse engineering or decompiling the VehTap Platform.
  • Using automated bots or scrapers without written authorisation.
  • Circumventing the privacy and masking mechanisms of the Service.
  • Reselling or commercially exploiting VehTap Tags or Services without consent.
  • Uploading malicious code or harmful software through the Platform.
  • Violating any applicable law or regulation.
  • Impersonating any person or entity.

VehTap reserves the right to suspend or permanently deactivate any Tag or account found to be in violation, without notice.

6A. Fair Usage, Abuse, and Tag Deactivation

VehTap's Services are intended for legitimate, personal vehicle contact use. VehTap does not prescribe fixed numerical limits on usage but reserves the right, at its sole and absolute discretion, to determine what constitutes fair and acceptable use of the Platform and its features, including but not limited to the contact relay, masked calling, SMS, and QR scan functionality.

Without limiting the generality of the foregoing, the following conduct is considered abusive and may result in immediate action by VehTap, with or without prior notice:

  • Repeated or automated scanning of Tags in a manner inconsistent with genuine contact intent
  • Excessive use of the masked call or SMS relay in a manner that places unreasonable load on VehTap's infrastructure or third-party providers
  • Any use of the Service to harass, spam, stalk, or intimidate an Owner or Scanner
  • Any attempt to reverse-engineer, stress-test, or exploit the contact relay or masking system
  • Any pattern of use that VehTap, in its sole judgment, determines to be inconsistent with normal personal use

VehTap's determination of what constitutes abuse is final and binding. Users have no right to appeal a usage restriction or suspension on grounds of disagreement with VehTap's assessment.

Tag Deactivation

VehTap reserves the right to deactivate any Tag, suspend any account, or restrict access to any feature of the Service at any time, with or without prior notice and with or without giving reasons, where VehTap determines in its sole discretion that:

  • The User or Tag is being used in an abusive, fraudulent, or unauthorised manner
  • Continued activation poses a risk to VehTap's infrastructure, reputation, or other Users
  • The User has violated any provision of these Terms
  • VehTap is required to do so by applicable law or regulatory authority

Upon deactivation of a Tag, the QR code on the associated physical sticker will cease to function. VehTap shall not be liable for any inconvenience, loss, or damage resulting from Tag deactivation. No refund shall be payable in respect of a deactivated Tag where deactivation resulted from a breach of these Terms.

Account Deletion

Users may request deletion of their account at any time by contacting support@vehtap.com. Upon deletion, all Tags associated with the account will be permanently deactivated. Account deletion is irreversible. VehTap will process deletion requests within a reasonable period subject to any legal data retention obligations.

6B. Partner Programs

VehTap operates a Seller Program and a Referral Program that allow eligible individuals to earn commission by selling or promoting VehTap products. Participation in either program is subject to separate program-specific terms and agreements provided to participants at the time of onboarding.

In the event of any conflict between these Terms and any program-specific agreement, the program-specific agreement shall prevail to the extent of the inconsistency.

VehTap reserves the right to modify, suspend, or terminate either program at any time, with or without notice. Changes to commission rates, eligibility criteria, or payout terms shall be communicated through the applicable program agreement or participant dashboard. Continued participation in a program following any such change constitutes acceptance of the revised terms.

Participants in any VehTap partner program are independent parties and not employees, agents, or partners of VehTap.

6C. Scanner Conduct

Any person who scans a VehTap Tag to initiate contact with a vehicle owner ("Scanner") agrees to the following by virtue of accessing the scan page at vehtap.com:

  • The contact relay service is to be used solely for legitimate, good-faith contact with the vehicle owner
  • Scanners must not use the relay to harass, threaten, intimidate, or stalk any vehicle owner
  • Scanners must not attempt to identify, extract, or trace the personal information of any vehicle owner through the relay system
  • Scanners must not initiate repeated or automated contact attempts in a manner inconsistent with genuine communication intent
  • Any misuse of the relay service by a Scanner may be reported to law enforcement and VehTap reserves the right to provide relevant technical information to authorities in connection with any investigation

Scanners who misuse the Service may be blocked from accessing the scan page and VehTap reserves the right to restrict or deny access to any Scanner at its sole discretion without notice.

7. Privacy and Data Protection

7.1 Data Collected

  • Phone number (OTP authentication and masked call relay).
  • Vehicle details (plate, type, model, colour) — provided voluntarily.
  • Name — provided voluntarily.
  • Email address (order confirmation and PDF delivery).
  • IP address and approximate geolocation at time of QR scan events.
  • Transaction data including Razorpay order and payment identifiers.

7.2 How Data Is Used

  • Authenticate Users via phone OTP.
  • Relay contact attempts without exposing either party's phone number.
  • Deliver order confirmations and PDFs by email.
  • Maintain the Owner's dashboard and tag management features.
  • Prevent fraud and misuse.
  • Comply with legal obligations.

7.3 Phone Number Privacy

VehTap's core value proposition is the protection of the Owner's phone number. The Owner's registered phone number is NEVER disclosed to any Scanner. All call and SMS relay is conducted through masked communication channels.

7.4 Data Retention

VehTap retains User data for as long as the account remains active. Users may request deletion by contacting support@vehtap.com.

8. Intellectual Property

All content on the VehTap Platform, including the brand name "VehTap", the logo, taglines ("Reachable. Not traceable."), website design, text, graphics, and code, is the exclusive intellectual property of VehTap and its proprietor.

You may not reproduce, distribute, modify, or commercially exploit any VehTap content or intellectual property without prior written consent.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

VehTap provides the Platform on an "as is" and "as available" basis. VehTap makes no warranty that the Platform will be uninterrupted or error-free.

9.2 Communication Relay

VehTap acts solely as a conduit for communication between Scanners and Owners. VehTap is not responsible for the content or outcome of any communication through the relay system.

9.3 Limitation of Liability

To the maximum extent permitted by law, VehTap shall not be liable for any indirect, incidental, special, or consequential damages. VehTap's total aggregate liability shall not exceed the amount paid by you for the specific product in the twelve (12) months preceding the claim.

9.5 Third-Party Service Providers

VehTap's Services depend on third-party technology providers to deliver core functionality, including but not limited to payment processing, communication relay, cloud infrastructure, messaging, and email delivery. VehTap does not warrant the continued availability, performance, or reliability of any third-party provider.

From time to time, VehTap may add, replace, or discontinue third-party providers to improve, maintain, or enhance the Service. Such changes may occur without notice and shall not constitute a material change to these Terms. VehTap shall not be liable for any disruption, degradation, or loss of service arising from the failure, modification, or discontinuation of any third-party provider.

Your use of the Service is also subject to the terms and privacy policies of the relevant third-party providers. VehTap recommends that you review those terms independently.

10. Indemnification

You agree to indemnify and hold harmless VehTap and its proprietor from any claims arising out of:

  • Your use of the Platform or Services.
  • Your violation of any provision of these Terms.
  • Your violation of any applicable law or the rights of any third party.

11. Termination and Suspension

VehTap reserves the right to suspend or terminate your account without prior notice if:

  • You violate any provision of these Terms.
  • VehTap has reasonable grounds to believe your account is being used fraudulently.
  • Required to do so by applicable law.

12. Modifications to Terms

VehTap reserves the right to modify these Terms at any time. Modifications are effective upon posting with a revised effective date. Your continued use of the Platform constitutes acceptance of any changes.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the Republic of India. Disputes are subject to the exclusive jurisdiction of courts in Nagpur, Maharashtra, India.

13.2 Dispute Resolution

Disputes shall first be attempted to be resolved through good-faith negotiations for 30 days. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. Seat of arbitration: Nagpur, Maharashtra. Language: English.

13.3 Consumer Rights

Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2019.

15. Miscellaneous

15.1 Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and VehTap.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

15.3 Waiver

VehTap's failure to enforce any right shall not constitute a waiver of that right.

15.4 Assignment

You may not assign your rights under these Terms without VehTap's written consent.

15.5 Force Majeure

VehTap shall not be liable for failures caused by events beyond its reasonable control, including acts of God, pandemic, government actions, or third-party service provider failures.

15.6 Language

These Terms are drafted in English. The English version prevails in any conflict.
